POS: From today their statement to AADE

The AADE activates a new network of electronic monitoring, control and cross-checking of transactions in the market with the “file” of POS which starts from today Friday, September 22, 2023. In the digital portal myAADE a Registry of Means of Payment (POS) is established and maintained with payment service providers being asked today to declare all the POS used by businesses to accept card payments.

This move is one more step before the mandatory interconnection of 450,000 cash registers with the POS which, based on the schedule, will be completed within the first months of 2024 and will close the channels of tax evasion by not issuing receipts. The next step is to expand POS usage throughout the market.

With the “folder” of all POS, the auditors will know before visiting the businesses to check the number of POS they have, which are declared and which are used legally or illegally.

Through the process of creating a POS Register, AADE will see for each machine the full details of the Payment Services Users, from VAT number and name to the date the POS started operating and the bank account with which it is connected. The registration also applies to foreign POSs for which the name, foreign tax registration number or other functionally equivalent identification number, country of registered office or permanent establishment of a foreign Payment Means Provider will be declared.

How will POS be declared

According to the decision of the AADE, the active POS of businesses will be declared automatically, through an interface (API), every ten days:

  • by the Payment Service Providers (Acquirers) that clear transactions paid for using payment cards and
  • by the Payment Service Providers (NSPs) who provide, install and manage POS terminals

In the case of Payment Service Providers (Acquirers) the date of first implementation of the relevant obligation is set as September 22, 2023 with submitted data related to active Payment Instruments on September 10, 2023.

For the period from 11 to 30 September 2023, the relevant declarations are submitted until 5 October 2023.

In the case of Means of Payment Providers (NSPs) the date of first application of the relevant obligation is defined as September 26, 2023 with submitted data relating to active Payment Means on September 10, 2023.

For the time period from 11 to 30 September 2023, the relevant declarations are submitted until 5 October 2023.
